It is the dream of many people to start a business in Australia. Although there are a series of steps that need to be followed in order for a foreign party to register a business, it is an entirely feasible goal. By simply going through this process with an immigration lawyer, it will be possible for a person to start a business without a great deal of trouble.

1. Enter the Name of the Business to Register:
Before a company can be created, it is necessary to check that the name a person may want for the company is currently available. It is easy to search for the name on the Organisations and Business Name Search site. Another great resource is the Identical Names Check Search. If the name is still available and does not contain any material that might mislead a consumer or is considered to be offensive, it can be registered. 

2. Reserve the Name:
The next step is to reserve the name to make sure that it is not taken by using this form. A fee will need to be paid with this form. The amount will be specified as the paperwork is being filled out. 

3. Fill Out the Foreign Company Registration Paperwork:
The next step is for the company, along with a migration consultant, such as Hunt Migration, to fill out the Form 402 Application for registration as a foreign company. This form will require the person filling it out to provide details regarding the nature of the company and needs to be totally completed in order for it to be accepted. 

4. Find All of the Necessary Documents:
The next step is to find a number of different documents, along with the Form 402 Application. An immigration lawyer will be able to assist with this process. One document that is needed is a certified copy of the constitution that will govern how the company will function, in terms of shareholders and leadership. It will need to be signed by a notary in order for it to be accepted. It will also require this form, which is executed by a local agent in Australia. The local agent needs to be a person or a company located in Australia, a person who is a resident of Australia, and is fully authorized to accept service of process and notices from foreign companies. The last document is a signed memorandem that discusses, in detail, the different responsibilities and powers of various directors. All documents must either be in English or translated to be in English. A fee needs to be paid when these documents are submitted.

5. Submit Everything
After the migration consultant has reviewed the entire packet, the forms all need to be submitted. All of the forms and documents can be mailed to:

Gippsland Mail Centre VIC 3841. As soon as the application has been processed, an Australian Registered Body Number (ARBN) and a Certificate of Registration will be produced.
